Vanessa Hudgens has asked for a lawsuit filed in September to be dismissed. The lawsuit alleges she owes her former attorney $150,000. Hudgens’ attorney says she was only 16 when she signed the deal, so the deal is not valid. In his suit, attorney Brian Schall claims he helped Hudgens earn more than $5 million by advancing her funds for her songwriting and recording career. The suit says that Vanessa "has paid some, but not all, of the money owed …"

Court papers filed Monday by Hudgens’ lawyer, Evan N. Spiegel, say California’s Family Code "provides that the contract of a minor is voidable and may be disaffirmed before (age 18) or within a reasonable time afterward," which means Vanessa was too young to sign the deal. The contract in question was initially signed in October of 2005, and Hudgens officially disaffirmed the contract on October 9, according to court documents. A copy of a two-paragraph letter from Hudgens to Schall nullifying their agreement is attached to her court papers, as is a copy of her birth certificate, which states that she was born December 14, 1988. The court papers also say the agreement was with the law offices of Schall, not with Schall himself.

One of our readers already pointed out that Vanessa may not be held to that contract because she was too young. Here’s what HG reader Yirmin Snipe said at the time of our first report about this lawsuit:

Sounds like the lawyer isn’t much of a lawyer… If he was he would know you can’t hold a minor to a contract they signed as a minor… Let me see… 2005 was what 2 years ago and She’s 18 now…. Hmmmm… My spidey sense of math says she was 16 and the lawyer was an idiot.

We have some smart, educated and handsome readers.

The reader is correct. A minor cannot be held to this type of contract and the attorney should have known enough to have a parent or guardian co-sign to assume responsibility. He’s a kind of a dumbass.

It’s too bad that Vanessa Hudgens and her lawyer are stupid too. Regardless, the previous lawyer can still sue for unjust enrichment of Hudgens despite the fact that the contract is voidable. That means that not only can he get back what she owes him for advancing the funds, but he can also be able to get back any increased earning capacity she’s received as a result of his help. So it doesn’t matter if the contract is not effective because she was a minor, the court will still probably award the previous lawyer some sort of reparations for the investment, which means Hudgens will still need to fork out a pretty penny for it.
