No, that’s not what it means.
If the conviction is upheld by the appeals court, he’ll still have to do the 3 years.
What the judge meant in this quote is that the appeal itself could take 3 years. So, it wouldn’t be fair to make Snipes sit in jail for 2-3 years and then end up winning his appeal and not having to do any jail time after all.
He may very well wind up behind bars here.
