Lindsay Lohan Settles Lawsuit

Lindsay Lohan has settled a lawsuit filed by a busboy who claimed she was drunk when she hit him with her car in October of 2005.

Raymundo Ortega filed the suit last June, even though the cops said he was to blame for the wreck on Robertson Blvd. Ortega, alleging that a then 19-year-old Lindsay was pounding drinks at the Ivy before hopping in her Mercedes-Benz and driving off, had sued for at least $200,000 in damages.

Ortega also sued the Ivy, claiming they were responsible because they had served her drinks. That case was dropped last month.

The terms of Lohan’s settlement are confidential. This could just mean that Lohan decided to personally settle with Ortega with some of her professional services rather than cash, which could be what he was after all along, but Lohan was playing hard to get, even though she’s not. Hopefully he gets whatever it is on tape.

A woman, Tracie Rice, who was in the car that Lindsay Lohan chased before being arrested says the incident caused emotional trauma and cost her thousands of dollars in doctors’ bills and a well-paying job.

Tracie Rice was in a car driven by Michele Peck, the mother of Lohan’s assistant who had recently quit, when Lohan trailed them to the Santa Monica Police Department headquarters during a pre-dawn July chase. Peck told police she was being chased by a sport utility vehicle, and police later determined Lohan was the driver.

In August, Rice filed a lawsuit against Lohan for emotional distress. The lawsuit seeks unspecified damages and payment of medical and other expenses related to emotional distress. Rice spent about $7,000 on medical bills, including a therapist who charges $175 per visit, and lost her $60,000 per year job because of the incident.

Rice said she thought she was being carjacked when an SUV, driven by Lohan, pursued them at high speed, putting her and Peck "at extreme risk of death or injury," until they arrived at the police station and were met by officers with guns drawn.

Lohan is facing another lawsuit because of an October 2005 accident that injured a busboy, Raymundo Ortega, who is seeking $200,000 in damages for negligence from Lohan and The Ivy, the trendy Beverly Hills restaurant where she ate before the June crash. Lindsay claims she wasn’t drunk when the crash happened, but it’s likely no one will believe her.

In September, Ortega’s attorney, Robert G. Klein, asked the court to amend the lawsuit to include Lohan’s company, Crossheart Productions Inc., because it owns the vehicle she was driving. But in papers filed last month in Los Angeles Superior Court, Klein dropped that part of the lawsuit.

Lindsay is trouble.

Lindsay Lohan is back in Los Angeles to start filming the tango-themed film Dare to Love Me, the film for which she was preparing in July when she was arrested for DUI. Lindsay still has to serve a 24 hours jail sentence she got as the result of a plea deal after her arrest for 2 DUIs, 2 counts of possession of cocaine, transporting a narcotic into a custodial facility, driving on a suspended license, drinking underage and fleeing the scene of an accident. In California Lindsay can check-in to jail just before midnight, and then leave jail just after midnight, which is then considered one day in jail.

Lindsay is also counter-suing Raymundo Ortega over a accident in West Hollywood in 2005. Raymundo claims Lohan was negligent, saying she was allegedly looking over her shoulder for paparazzi rather than watching the road when her Mercedes-Benz collided with his van. In Lindsay’s filing last week, Lohan claims it was Ortega who was negligent.

I’m starting to think that I’m living in an alternate universe where up is down, left is right, and rich celebrities can get away with anything.
