Madonna instructed her attorney to appeal a ruling by a judge in Malawi denying her adoption of a three year-old girl named Mercy James. The attorney will appeal to the Malawi Supreme Court.

To adopt a child in Malawi the prospective parent must have residency there for 18 to 24 months before a request to adopt a child there. Madonna got around that rule with David Banda, and after arriving days before her request this time, she expect the courts to bend the rules again.

Madonna’s lawyer Alan Chinula was so confident Madonna would get the adoption approved, he said before that hearing:

"I am not sleeping sleepless nights over this. I don’t see any law in Malawi that can stop this adoption."

Part of the law is the residency requirement. What he didn’t expect was an honest judge to rule against them.

A judge rejected Madonna’s request to adopt a three year-old little girl named Mercy from Malawi. Madonna had not attended the hearing in person.

The reason, according to sources involved in the hearing, but not the judge, said Madonna was rejected because she is not a resident of Malawi. Malawi adoption regulations require that prospective parents live in the southern African nation for at least 18 months. This adds fuel to the speculation that Madonna bought David Banda, rather than going through normal adoption channels.

There is also speculation that Madonna’s divorce, and her admission that she has spanked David for riding a horse alone, may have also factored into the decision against her request to adopt Mercy.

If Madonna truly wants to help Mercy have a better life going forward, she should give financial assistance to her existing family, including a grandmother and uncle, who can care for Mercy themselves, if they have the money to do so.

For the first time since being adopted by Madonna in 2006, David Banda met his biological father Yohane Banda at a lodge in Lilongwe, Malawi. The chemistry between father and son was amazing! After the meeting Yohane said:

"He asked me who I was. When I told him "I am your daddy" he looked surprised. It’s amazing how David has grown; I can’t believe he is the same small and sickly baby we left at Home of Hope. He seems to be a polite boy for he asked if he could sit on my lap. Then he started playing with my nose; I don’t know why. He is quite chatty and intelligent.

He asked me lots of questions about lots of things. He asked me whether I ride horses. I told him horses are for the rich and he asked me why I am poor. He told me his mum likes riding horses and that he too rides horses. Then he told me a story when one day he and his brother, Rocco, rode horses and fell. He told me his mum spanked him because they are not supposed to ride horses on their own.

He told me his mum plays music and asked me what I do for life. I told him I was a farmer. He asked what a farmer does and I explained to him that we use hoes to till the land. He told me his daddy, Mr. Ritchie, took him to a farm but it had a tractor. I told him in Africa we use hoes.

He seems to like his daddy, Mr Ritchie, so much that I was a little sad Madonna broke up with him. I would have loved it if they sorted out whatever problems they had instead of divorcing because divorce is bad for kids.

I was very happy to meet David again. He reminds me of the two sons I lost in infancy. I sometimes shudder to think that David could also have met the same fate had Madonna not adopted him. I am really grateful to her for saving David from possible early death.

Madonna is in Malawi trying to adopt a girl named Mercy pictured below. Madonna publicly acknowledged her efforts to adopt for the first time today, and said she is going through the normal process after concerned child advocates accused her of trying to "buy" another child. We’re curious to see if Madonna’s habit of spanking David, and recent divorce, will factor into the adoption process.

Madonna and her boyfriend Jesus Luz attended a Purim party at the Kabbalah center in New York City last night.

Madonna dressed as her daughter Lourdes, because she’ll never grow up. Jesus dressed as The Joker, no joke, and left with Jerry Seinfeld’s wife Jessica to try to keep from being recognized. It wasn’t hard to spot him. All we had to do was look for someone who didn’t belong there.

Perpetual teenager Madonna was out with her much younger boy toy Jesus Luz in New York City. After visiting a gay bar Jesus learned never to mention Britney Spears in Madonna’s presence. Page Six said:

Lady Madge stopped by Hell’s Kitchen gay bar The Ritz on Monday to attend her trainer Tracy Anderson’s birthday party when the DJ threw on a Spears track. "She flipped out, stormed upstairs, and spent the rest of the night aggressively making out with Jesus [Luz, her new boy toy]," says a spy.
