Ashley Alexandra Dupré, the prostitute that caused New York Governor Eliot Spitzer to resign, filed suit Monday against Girls Gone Wild founder Joe Francis and his film company. Ashley is asking for $10 million in damages. The prostitute claims that Girls Gone Wild representatives approached her while she was vacationing in Florida in 2003. Ashley also claims that representatives offered her alcohol, before inducing her to expose her breasts for cameras, and to sign a release form, even though she was 17 years old, and not of legal age to properly enter into any contract. The suit alleges that Girls Gone Wild has illegally exploited Ashley’s name, picture, voice and likeness in a number of deceptive advertising campaigns and on Web sites.

The whore for money refused an offer from Francis to legally distribute Ashley’s image, but later Francis withdrew the offer after his legal team informed him that despite Ashley’s age, she was legal since she did nothing sexual with another person. The suit itself sounds exactly like the one other girls filed against Francis, which landed him in jail. This time however, Francis made sure everything was legal before using the Ashley images and footage. Now Ashley will have to prove her claim in court, which won’t be easy since she herself committed fraud by lying about her age, and is a known prostitute. No one had to "induce" Ashley into acting like the whore she is famous for being.

Joe Francis, said in March that even if Ashley was 17, Florida and Federal law permits her to be filmed in any state of undress … as long as she consents and there is no "sexual contact." Joe says there was "no sexual contact."

Joe Francis says he will give away a Hookers Gone Wild DVD, featuring Eliot Spitzer’s hooker (call girl) Ashley Dupre. Joe will give the DVD away for free with the new issue of his magazine. Joe said:

"We could release it on the internet. The problem with the internet, the minute we put it up there, even if we’re charging, it’s out."

Joe is right, but someone will rip the video from the DVD the minute it hits news stands, and go right to the Internet anyway.

Ashley Dupre, the hooker the screwed Eliot Spitzer, appears to have been only 17 years-old when she made a Girls Gone Wild video for Joe Francis. Her lawyer, Don Buchwald, says Ashley’s birthday was April 30, 1985, and the footage was shot between March 13 and March 20, 2003, making her 17.

Joe also says Girls Gone Wild has a "corporate policy" not to use girls under 18, and so they have "delayed the release of Ms. Dupre’s n*de footage on the Internet and are investigating the matter."

Better to be safe, than in jail, right Joe?

Joe Francis is very happy to be out of jail. Paparazzi caught up with him at LAX. He’s obviously been humbled by this whole horrible nightmare. Who wouldn’t be?

Joe Francis made an appearance at the Panama City, Florida court today. He made a plea deal, and plead no contest to filming underage girls. Joe has been fighting these charges since 2003. He was sentenced to time served, and Girls Gone Wild can’t film in the area for three years. Bay County agreed to return Joe’s brand new Ferrari, and $60,000 that they confiscated from him last year. Joe said:

"I am happy to be done with Bay County."
