The parents of balloon boy, are finally being charged on Friday after they plead guilty, according to the family attorney.

Richard Heene could be charged with a felony for attempting to influence a public servant. Mayumi Heene may be charged with a misdemeanor for making a false report. Mayumi is getting off easier because she is still a Japanese citizen so a felony conviction could mean deportation, and with a criminal record she may not be able to get a U.S. citizenship ever despite being married to a U.S. citizen. Mayumi won’t be deported however, because all her kids were born here, and authorities don’t usually like to tear families apart with deportation unless something really serious happened.

This is probably the last time Mayumi listens to Richard’s bright ideas, on the other hand, she knew what she was getting herself into.

Sheriff Jim Alderden also escaped being charged with a crime for telling the media the family was being investigated by child protective services.

Balloon Boy’s father, Richard Heene, is expected to be charged for his balloon hoax on Wednesday, and to that he says he will plead not guilty.

On September 28, 2009 Heene created a profile on realitywanted.com to try an get himself on a reality TV show again. This is some of the evidence the Sheriff will be using to prove Heene planned the stunt, and there have been people going on record to make the same claims.

A reality TV producer also came forward to talk about how mad he was at Heene for pitching a reality show to him where Heene and his sons chase storms. The reality producer said he turned Heene down when he discovered Heene also talked to TLC about the same show concept, but then tried to make it sound like his real reason was that Heene’s boys would have been put in "harms way." Uh huh, riiiiight.

The Heene parents have been reported to child services as well, so they are most likely starting to have marital problems due to all the outside pressure on the family. Just imagine how the boys must be feeling.

Since the media wants to see Heene behind bars they’ve dug up his criminal past.

Heene was arrested in April 1997 and charged with misdemeanor vandalism, vehicle tampering, and disturbing the peace.

On April 15, 1997, Heene pled no contest to vandalism and the other charges were dismissed. He was sentenced to 30 days in jail, 2 years probation and ordered to pay restitution of $100. Heene served only 4 days and was then placed under house arrest.

With all the backlash Richard put a sign on the door that read:

"Thank you for all of your support. We are not taking any interview any more. We are tired. Thank you. Heenes."

Richard’s grammar is just as good as Jon Gosselin’s so don’t judge.

At this point the media doesn’t need to ask anymore questions, they’ll just follow Heene’s legal, family, and marital problems. Richard really needs that reality show right about now to pay his legal bills.

The neighbors in Heene’s neighborhood look like they moved from Los Angeles when he did. Rough neighborhood.

On Saturday evening Officers from the Larimer County Sheriff Department showed up at the Balloon Boy Heene home with a search warrant. Cops removed a computer, and several boxes of evidence.

This morning Sheriff Jim Alderden announced he now believes the Balloon Boy incident was a "hoax," and a "publicity stunt" with the hope to land a deal for a reality TV show.

Alderden said he would files charges against both Richard Heene and Mayumi Heene, and the list of charges could include contributing to the delinquency of a minor, which is a felony, conspiracy, false reporting and attempt to influence an officer. The most significant charges they face could result in a maximum sentence of six years in prison and a $500,000 fine. The Sheriff said he would also talk to federal officials to see if federal charges will also be filed.

The Sheriff also notified child protective services who will now be conducting an investigation.

Alderden said that if the charges do go forward, they will seek restitution for all the expenses the county incurred. He doesn’t believe anyone would serve jail time because of the overcrowding situtation in Colorado and because it would be their first offense.

He did not set a time frame for when arrests would be made.

The sheriff also said this about Richard Heene:

"His education level is only high school … he may be nutty, but he’s not a professor."

We get the impression the Sheriff doesn’t think what the Heene parent did amounts to a serious crime, even though he’s being pressured into filing charges.

Some of the most obvious facts in this case that pointed to it being a hoax was the fact that Richard Heene called local news station 9 News before he called 911 to report their son may have left in a flying saucer shaped balloon.

Robert Thomas, a 25-year-old researcher, said Richard Heene drew up a master plan to generate a massive media controversy using a weather balloon. Thomas said:

Thomas spent several months earlier this year working on developing a reality science TV show to pitch to networks – the "show," Thomas says, that Falcon was referring to when he told CNN "We did it for the show." Among the ideas that Heene, Thomas and two others came up with for their reality TV proposal – and one that he says most intrigued Heene – involved a weather balloon modified to look like a UFO which they would launch in an attempt to drum up media interest in both the Heene family and the series he was desperate to get on the air. Still, Thomas never imagined that Heene would involve his six-year-old son in what he is certain was a "global media hoax" to further Richard Heene’s own celebrity…

At this point it seems the Heene’s best defense could be "The bad economy made me do it."

Sheriff Jim Alderden said after a second interview late Saturday with Richard Heene and Mayumi Heene that misdemeanor charges will now "likely be filed" against one or both the parents.

Alderden added that he would be checking with federal officials to see if they would be filing charges as well.

Alderden said on Friday during a nationally televised press conference that he was "convinced" the family was telling the truth. It seems the Sheriff is not able to come to conclusions on his own.

The Sheriff will make another statement later today.

Richard Heene told reporters about 5:30 AM this morning:

"I’m going to have a press conference out here at, let’s say, 10 a.m. Okay? … So it’s a few more hours. So, I’d like to speak everybody about a few things. Okay? So, it’s a big announcement."

Heene then had his big press conference in front of his home where his big announcement was that he would be putting a box on the front step where people can write down questions, which he will answer later tonight. Heene says he is getting calls, and emails, from friends about what people are saying about them, but he doesn’t have cable, so he doesn’t know what is going on.

Why even worry about what other people are saying? Maybe because they have been trying to get TLC, or any network to contract their family for a reality TV show. All this attention could help.

Heene did answer one question saying the balloon boy incident was "not a hoax."

Sheriff Jim Alderden from the Larimer County Sheriff’s Department said so far they do not consider the balloon boy incident as a hoax.

The 911 operator had a very difficult time getting the Heene’s to stay on the phone with her. It seems Richard has a little touch of attention deficit disorder.
