It seems he learned nothing from his friend Jamie Waylett (20), also a Harry Potter actor pictured below with Herdman, who narrowly escaped prison after he was arrested for growing cannabis in his bedroom.
The picture of Josh is believed to have been taken in Amersterdam where marijuana is legal.
