Anna Nicole Smith Won’t Submit to DNA Paternity Test, Anna Gets Evicted and Buys a New House

Today is the day that Anna Nicole Smith is supposed to submit herself and baby Dannielynn to a DNA paternity test to determine if in fact Larry Birkhead is or is not the father of Dannielynn.

Anna Nicole’s lawyers are trying to block the test on grounds that the United States DNA lab hired by Larry Birkhead, the man claiming to be the father of little Dannielynn, cannot legally administer the test because its technicians don’t have work permits for the Bahamas.

Smith’s lawyers are also arguing that the order requiring the test was never brought before a Bahamian judge. A Los Angeles Superior Court judge ordered the test, but Smith’s lawyers now say it’s not binding until a Bahamian judge gives it a stamp of approval. Smith’s lawyers are in Los Angeles County Superior Court this morning trying to block the test. The judge has not issued a definitive ruling on Smith’s motion and so far the DNA test has not happened.

Smith claims she has nothing to hide, but she’s doing everything possible to hide the true father of baby Dannielynn.

TMZ obtained an AOL Instant Message exchange yesterday between Anna Nicole Smith and Larry Birkhead. Anna Nicole made it clear that she’s not going to submit to a DNA paternity test without a fight.

The following is a precise transcript, complete with spelling and grammatical errors (but the user names have been changed):

Anna Nicole quit trash me at the casino
Larry not at a casino
Anna Nicole go f**k my mom to
Anna Nicole Yall are sick
Larry show up for the test with the baby’
Anna Nicole don’t think so
Anna Nicole u wish
Larry everybody just want u to do right thing is all
Anna Nicole in your dreams

It’s time the Los Angeles judge issued a warrant for Smith’s arrest, and ask the Bahamas to extradite her to the United States be processed by the court.

Anna Nicole Smith was facing deportation because she didn’t own the house she was in, and after losing a legal battle in which she claimed her current house was given to her as a gift and claiming the home owner, G. Ben Thompson, was Dannielynn’s daddy, she went out and bought a house of her own with the money she made by selling the last pictures of her son Daniel Smith with her baby Dannielynn, a mock wedding, and her story. Now that Smith is a home owner, the Bahamas may no longer have a case to deport her, which is again why the Los Angeles judge needs to order a warrant for her arrest and request her extradition to the United States.

The problem may be that the United States does not have a law forcing women to have a paternity test, and there also no laws to prosecute women for falsely naming a father when a paternity test proves it was a fraudulent claim. There are fraud laws, but they are never enforced when it comes to women fraudulently naming fathers. Father’s have few if any rights, and women like Smith can deny the father his rights with impunity. Father’s rights laws are needed to correct this inequity.
